Judge Throws out Organic Farmers’ Recent Case Against Monsanto
For years Monsanto has been trying to take out American family farms and dominate the agricultural industry with their genetically modified seeds. Between 1997 and 2010, 144 lawsuits were filed by Monsanto against American family farmers, with an additional 700 being settled out of court. Recently, farmers made a firm decision to institute massive resistance against the biotech corporation by launching their own landmark lawsuit against Monsanto for contaminating crop fields with GMOs. The landmark case has now been thrown out by a New York federal court.
Judge Sides with Monsanto
In a lawsuit originally filed in March of 2011, the Public Patent Foundation represented various individuals and organizations threatened by Monsanto and their GMO crops. Family farmers, farming organizations, and seed businesses all took a stand in a case known as the Organic Seed Growers and Trade Association (OSGATA) et al v. Monsanto.
Seeing as Monsanto is stampeding over much of the farmland with their questionable and dangerous genetic manipulations, it isn’t surprising to see a case safeguarding farmers from Monsanto’s own lawsuits while also disputing the company’s patents on GMO seeds.
Unfortunately, the case seems to be unfolding in Monsanto’s favor. In fact, a New York court yesterday dismissed the lawsuit. The Organic Seed Growers and Trade Association was hoping that the judge would disallow the use of Monsanto’s seeds as they drift into organic fields, but instead the judge found the plaintiffs’ allegations to be “unsubstantiated … given that not one single plaintiff claims to have been so threatened.” In addition, the ruling said the plaintiffs overstated the magnitude of Monsanto’s patent enforcement.
“Beyond whatever happens with this suit, there are some very legitimate issues behind it,” Doug Gurian-Sherman, a senior scientist with the Union of Concerned Scientists, tells The Salt. “There is already a significant burden to organic food production, and there is more coming. It raises the question: Is it possible for organic agriculture to survive in the face of GM crops?”
Following current trends, genetically modified foods will makeup the majority of the future food supply if a change is not made. Statistics show how GMO crops and ingredients have skyrocketed in even the past few years.

The Judiciary is corrupt like everything else in America. You can't even get a judge to hear Obama's birth case. Between Masonic orders, sexual misconduct and good old plain bribery the judiciary is just as corrupt as the legislation and executive branches. America has become an evil empire run by corporations like Monsanto.
You hit the nail right on the head…WE, THE PEOPLE have allowed our political system to be entirely usurped and overrun by people who do not have our best interests at heart.
What to do? It's gonna be a long, hard slog now because we have ignored our responsibilities for so long…but we have to run for political offices at the grass roots level…city councilmen…local government…these are elected positions that we can run for and WIN w/o spendi9ng a fortune to do so.
The powers that be have built their foundation on controlling local politics…we have to take it back if we really care about the direction the country has taken. The executive, legislative and judicial branches have all been infested with people who, in many, many instances, began their careers in these local political offices that we tend to ignore. A city court judge elected for TEN YEARS!!! What is this all about? 10 years and the guy probably was a marginally capable lawyer to begin with!! Couldn't make it as a lawyer so he ran for judge and was elected for TEN 'effin' YEARS!!! How many of these are sitting in their unruffled robes wielding powers that they could never wield otherwise!!!
I guess you can summarize this mess by saying that we're getting the form of government that we deserve! Only problem is our kids don't deserve the mess and corruption that we're leaving to them.
The courts will NEVER offer relief for cases like this.

My question is what connections does this "federal Judge" have with Monsanto and what does he stand to gain to obviously rule against those he has signed an oath to protect? It was nothing but another dog and pony show and every time you deal with these fascist corporate systems, most call courts and the justice system,they protect their own. Call it as it is, the justus system. Gee, Monsanto also now has it's own military called Black Water. Isn't that special?

I don't post often and it is because I don't believe there is much effect in doing so.
But . . . I have been listening to a research group on the talkshoe.com network – AIB County Assembly. They have, through actual court cases discovered that a knowledgeable man/woman can move an action into a true Article III constitutional court. Totally different rules there. Attorneys have little force in this venue if they can argue at all. It appears that every federal (and local subsidiaries of this venue) judge can also function as a judge for a
district court of the United States
Please note the lower case "district court". Keeping an action in this venue may take persistence but can be done. Most attorneys will move your action (on your behalf supposedly) into the United States District Court (often all caps). This is not the same court venue but it can be the exact same room and judge. This is also a territorial court, not an article III court.
Monsanto will have a difficult time defending it's actions in the 'district court of the United States' instead of the usual 'judge rules' in the USDC.

As long as the prosecuting and defense attorneys rule the clients actions you will not find yourself in the proper court. Their response will be 'it's the same court' or 'it doesn't make any difference.'

I have to touch the same key: if some judge(s) is(are) against many obvious issues presented by knowledgeable people — something we have to do to minimize our lost of time and energy. Investigate if those judge received some compensation(s), and breaking the law. Then we can eliminate that one(those) by disqualification. Of coarse they receive compensation. Monsanto will do anything to sell this crap ! Most of out judges today are just as evil as our government. There is no recourse in America today. It's all about money, greed and power. We are so screwed !
